Terms of service

Westbury — Terms of Service

Last updated: 16-10-2026

These Terms of Service govern your access to and use of the Westbury website, online store, and related services. Please read them carefully. They include important information about your legal rights, including warranty disclaimers and limitations of liability.

1. About these Terms

The terms “Westbury,” “we,” “us,” and “our” refer to the business operating this store. Westbury operates this website and online store, including the information, content, features, tools, products, and services made available through it (collectively, the “Services”), to provide customers with a shopping experience.

The Services are powered by Shopify, which provides the commerce platform that enables us to offer the Services. Depending on the location and structure of the store, relevant Shopify entities may include Shopify Inc., Shopify Commerce Singapore Pte. Ltd., or Shopify International Limited.

These Terms, together with any policies expressly incorporated by reference, form the agreement between you and Westbury regarding your use of the Services. Our Privacy Policy explains how personal information is handled. If you do not agree to these Terms or the Privacy Policy, do not access or use the Services. Nothing in these Terms limits rights that cannot lawfully be excluded under applicable consumer-protection or other mandatory laws.

2. Eligibility and accounts

By using the Services, you represent that you are legally able to enter into a binding agreement under the laws that apply to you. If you are under the age of majority where you live, you may use the Services only with the involvement and permission of a parent or legal guardian, where required by law.

You may be asked to provide information such as your email address, billing details, payment information, and shipping address when browsing certain features or placing an order. You agree to provide information that is accurate, current, and complete and to update it when it changes.

You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account, except to the extent applicable law provides otherwise. Do not sell, transfer, assign, or allow another person to use your account without our permission.

3. Products and product information

We make reasonable efforts to display product descriptions, images, colours, and other information as accurately as possible. The appearance of a product may vary depending on your device, display settings, lighting, or other factors. Product images and descriptions are provided for general information and may not show every detail.

Product information, availability, descriptions, and prices may be corrected or updated from time to time. We may discontinue a product or limit quantities available for purchase, subject to applicable law. Nothing in this section excludes any rights or remedies you may have under applicable consumer law.

Verification note: Confirm that product images and descriptions accurately represent products supplied by your retailers or dropshipping suppliers, and that you have permission to use any supplier-provided images or content.

4. Orders and order acceptance

Submitting an order is an offer to purchase the selected products under the information displayed at checkout. An order is not accepted until we confirm acceptance, subject to applicable law. We may decline, limit, or cancel an order where legally permitted, including where a product is unavailable, an apparent pricing or listing error exists, payment cannot be processed, or we reasonably suspect fraud or unauthorised activity.

If we cancel or change an order, we may try to contact you using the email address, phone number, or billing details provided with the order. If payment has already been collected for an order we cancel, we will arrange any refund required by applicable law and our applicable refund policy.

Please review your order carefully before submitting it. Whether an order can be changed or cancelled after submission depends on its processing and dispatch status and applicable law. Returns, exchanges, and refunds are governed by our published Return and Refund Policy, without limiting statutory rights.

You agree to purchase products for personal or household use unless we expressly agree otherwise in writing. Any restrictions on resale, export, or bulk orders must be applied consistently with applicable law.

5. Prices, taxes, and payment

Prices, discounts, and promotions may change without notice, but the price applicable to your order will be the price shown at checkout when you place the order, subject to correction of manifest errors as permitted by law. The order confirmation should identify the products and charges included in your purchase.

Unless stated otherwise at checkout, additional charges may apply, including shipping, taxes, customs duties, import fees, or other charges imposed by relevant authorities. The treatment of these charges depends on the destination, the shipping arrangement, and applicable law. Please review the amounts shown at checkout before completing your purchase.

You agree to provide current, complete, and accurate billing and payment information and to update it when necessary. You represent that you are authorised to use the payment method submitted. Payments may be processed by third-party payment providers under their own terms and privacy practices. We do not claim to store or process payment-card information ourselves unless that is in fact part of our operations.

Promotions may have additional terms. If promotion-specific terms conflict with these Terms, the promotion-specific terms will apply to the extent of the conflict, subject to applicable law.

Verification note: Confirm which currencies, payment methods, taxes, shipping fees, customs charges, and payment processors are actually used by the store. Do not publish a promise about who pays import duties unless the fulfilment arrangement supports it.

6. Shipping and delivery

Shipping methods, delivery estimates, destinations, costs, and any applicable restrictions are described in our Shipping Policy and at checkout. Delivery dates and transit times are estimates unless we expressly guarantee them in writing. Delays may occur because of carrier operations, customs processing, supplier availability, weather, or other events outside our reasonable control.

We will address lost, damaged, or delayed shipments in accordance with our published policies and applicable law. Nothing in these Terms removes rights you may have if products are not delivered as required by law. Responsibility for loss or damage during transit is determined by applicable law and the specific transaction; these Terms do not automatically transfer all risk to the customer at carrier handoff.

Verification note: Confirm supplier dispatch times, the carriers used, delivery regions, tracking availability, the party responsible for customs clearance, and the store’s actual lost/damaged parcel process. Ensure this section matches the Shipping Policy and the fulfilment contracts.

7. Returns, refunds, and exchanges

Returns, refunds, and exchanges are governed by the Return and Refund Policy displayed on the website. Please read that policy before placing an order. Any eligibility conditions, time limits, product exclusions, return-shipping costs, and refund-processing estimates must be stated in that policy and applied consistently with applicable law.

Nothing in these Terms excludes or limits any non-waivable consumer rights.

Verification note: Add or link to the final Return and Refund Policy before publication. Do not imply that all products are returnable—or that no products are returnable—unless that accurately reflects the policy and applicable law.

8. Intellectual property

The Services and their content—including text, graphics, logos, designs, photographs, videos, audio, and other materials—may be owned by Westbury, its licensors, suppliers, or other rights holders and may be protected by intellectual-property laws. Product names, trademarks, and third-party materials remain the property of their respective owners.

You may access and use the Services for personal, lawful shopping purposes. Except where applicable law permits or the relevant rights holder has authorised it, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, republish, or commercially exploit content from the Services without prior permission from the relevant rights holder.

Purchasing a product does not transfer ownership of any intellectual-property rights in the product, its design, software, or associated materials. All rights not expressly granted are reserved by the relevant rights holder. Westbury and Shopify names and logos are trademarks of their respective owners and may not be used without permission.

Verification note: Confirm that Westbury has permission to use product images, descriptions, logos, and other content provided by suppliers or third parties.

9. Optional tools and third-party services

The Services may make features or tools available that are provided by third parties. We do not necessarily control or monitor those third-party services. Their availability and use may be subject to separate terms and privacy policies. To the extent permitted by law, third-party tools are provided according to the terms offered by their providers, and we are not responsible for matters outside our reasonable control.

We may add or change features of the Services over time. New features will also be subject to these Terms unless different terms are presented for them.

10. Third-party links

The Services may contain links to websites or services operated by third parties. These links are provided for convenience and do not necessarily mean that Westbury endorses those third parties. We do not control third-party websites and are not responsible for their content, availability, terms, privacy practices, or transactions. Review the relevant third party’s policies before using its services or providing information to it.

This section does not exclude liability or duties that cannot be excluded under applicable law.

11. Shopify’s role

The Services are hosted on and powered by Shopify’s commerce platform. Shopify provides technology that enables us to operate the online store, but purchases made through the store are transactions between you and Westbury, subject to applicable law.

Shopify’s handling of information in connection with its platform is described in Shopify’s privacy documentation. Please also read Westbury’s Privacy Policy to understand how information is handled by Westbury and the third-party providers we use. For more information about Shopify’s own practices, see [Shopify’s Privacy Policy](https://www.shopify.com/legal/privacy).

Nothing in these Terms creates a waiver of rights or claims that cannot lawfully be waived, or changes any responsibility imposed by applicable law.

12. Privacy

Our Privacy Policy describes how we collect, use, disclose, and otherwise process personal information in connection with the Services. By using the Services, you acknowledge that you have had the opportunity to review that policy.

Because the store uses Shopify, information about your use of the Services may be processed by Shopify to operate, secure, support, and improve the platform and to help detect or prevent fraud. Information may also be processed by service providers that support functions such as payment processing, order fulfilment, customer support, analytics, and advertising, where those providers are actually used by Westbury. Information may be transferred to or processed in countries other than your own, subject to applicable law and the disclosures in the Privacy Policy.

Read the https://admin.shopify.com/store/q0g1nb-vr/settings/legal/privicypolicy and Shopify’s privacy documentation for details. Do not rely on this section as a substitute for the Privacy Policy.

13. Feedback and reviews

If you submit suggestions, feedback, reviews, or other content to Westbury, you confirm that you have the rights needed to submit it and that it does not unlawfully infringe another person’s rights or violate applicable law.

To the extent permitted by law, you grant Westbury a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, and share the submitted content for purposes connected with operating, improving, and promoting the Services. This licence does not transfer ownership of your content. If a broader or perpetual licence is intended, obtain legal review and state it clearly.

We may remove or decline to display content where we reasonably consider it unlawful, misleading, abusive, infringing, spam, or otherwise inconsistent with our policies. We are not required to publish or respond to every submission. You remain responsible for the content you submit.

14. Errors and omissions

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates, or availability. Where permitted by law, we may correct errors, update information, or cancel an order affected by a material error. If we cancel an order after receiving payment, we will provide any refund required by applicable law.

We will not use this section to remove rights that consumers have under applicable law.

15. Acceptable use and prohibited conduct

You may use the Services only for lawful purposes. You must not use the Services to violate laws or regulations, infringe intellectual-property or privacy rights, harass or harm others, impersonate another person, submit knowingly false or misleading information, distribute malware, send unlawful spam, interfere with the operation or security of the Services, or attempt to gain unauthorised access to accounts, systems, or data.

You must not collect or misuse other customers’ personal information, interfere with checkout or payment systems, or use automated means to access the Services in a way that violates applicable law, these Terms, or technical restrictions. Nothing in this section prohibits activity that we cannot lawfully restrict, or activity expressly authorised by us in writing.

We may restrict or suspend access where we reasonably believe there has been a material breach of these Terms, fraud, a security risk, or unlawful activity, subject to applicable law.

16. Automated agents

If the Services are accessed by automated software or agents, that access must comply with applicable law, these Terms, and any technical restrictions communicated by Westbury or Shopify. Automated agents must not misrepresent their identity, evade security controls, bypass access restrictions, or continue accessing the Services after being instructed to stop.

We may use reasonable technical measures to manage automated access. This section does not grant permission to access any part of the Services that is otherwise restricted.

17. Suspension and termination

We may suspend or terminate access to the Services where permitted by law, including where necessary to address a security issue, suspected fraud, unlawful activity, or a material breach of these Terms. Where appropriate and legally required, we will provide notice or an opportunity to resolve the issue.

Termination does not affect rights, obligations, or liabilities that accrued before termination or provisions that by their nature are intended to continue. Consumer rights and other mandatory legal protections remain unaffected.

18. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as available” basis, and we do not guarantee that access will always be uninterrupted, timely, secure, or error-free. Information on the Services is provided for general information and should be checked where accuracy is important.

To the extent permitted by law, Westbury disclaims implied warranties or conditions relating to the Services. This disclaimer does not exclude express promises made by Westbury, product guarantees required by law, or warranties and consumer rights that cannot lawfully be excluded or limited.

19. Limitation of liability

To the fullest extent permitted by applicable law, Westbury will not be liable for indirect, incidental, special, consequential, or punitive losses, or for loss of profits, revenue, savings, data, or business opportunities, arising from use of the Services or products purchased through them.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury where such exclusion is prohibited, breach of obligations that cannot lawfully be excluded, or any other liability that cannot be limited under applicable law. This section applies only to the extent the relevant limitation is lawful in the customer’s jurisdiction.

20. Indemnification

To the extent permitted by applicable law, you agree to be responsible for reasonable losses or claims suffered by Westbury that arise directly from your unlawful use of the Services, your material breach of these Terms, or your infringement of another person’s rights. This section does not require you to indemnify Westbury for Westbury’s own unlawful conduct or for matters where such an obligation cannot lawfully be imposed.

21. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the extent necessary. The remaining provisions will continue in effect. This does not limit any non-waivable rights you may have under applicable law.

22. Waiver and entire agreement

If we do not enforce a provision of these Terms immediately, that does not mean we waive the right to enforce it later. These Terms and the policies incorporated by reference form the agreement between you and Westbury concerning the Services, except where additional terms are presented for a particular product, promotion, or feature or where applicable law requires otherwise.

23. Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent, except where applicable law permits otherwise. Westbury may transfer its rights or obligations in connection with a business reorganisation, sale, or transfer of the store, subject to applicable law and any required notice or consent.

24. Governing law and disputes

These Terms are subject to the laws that apply to the Westbury business, without excluding mandatory consumer-protection laws that apply where you live. Any court or dispute-resolution provision must be interpreted subject to non-waivable rights to bring claims in a competent local court or use a mandatory dispute-resolution process.

Verification note: The governing-law clause cannot be completed accurately until Westbury’s legal business identity, place of establishment, and intended sales markets are confirmed. Obtain legal advice before specifying a jurisdiction, exclusive venue, or arbitration process.

25. Language

If these Terms are translated, the translations should be reviewed for consistency with the English version. Any rule giving one language priority applies only to the extent permitted by applicable law and does not remove mandatory rights.

26. Headings

Headings are included for convenience and do not affect the interpretation of these Terms.

27. Electronic communications

When you use the Services or place an order, we may send electronic communications relating to your account, orders, purchases, customer service, and these Terms, subject to applicable law and your communication preferences. You are responsible for keeping your contact details current. Marketing communications, where sent, are subject to applicable consent and opt-out requirements and are described in the Privacy Policy.

28. Changes to these Terms

We may update these Terms from time to time by posting a revised version on the website. The “Last updated” date should be changed when revisions are made. Where required by law, we will give notice of material changes and obtain any required consent. Changes will apply from the effective date stated in the notice or revised Terms, subject to applicable law.

Publication checklist — remove this section before publishing

The following items could not be verified from the supplied document. Confirm them before publishing:

Legal business identity: Confirm the legal name of the person or entity operating Westbury, country of establishment, and business address. “Westbury” may be a trading name rather than the legal entity.

Effective date: Replace `[INSERT DATE BEFORE PUBLICATION]` with the date this version takes effect.

Policy links: Replace https://admin.shopify.com/store/q0g1nb-vr/settings/legal/privicypolicy and link the final Shipping Policy, Return and Refund Policy, and Contact Information policy.

Shopify entity and boilerplate: Confirm the applicable Shopify contracting entity and check the current Shopify-generated Terms language in your admin before replacing it. Shopify boilerplate can change.

Products and supplier arrangements: Verify product descriptions, image licences, availability, dispatch times, fulfilment responsibilities, returns process, and supplier permissions.

Markets and consumer law: Because the store targets India and international customers, obtain jurisdiction-specific review of consumer rights, mandatory disclosures, taxes, customs, delivery, refunds, warranty language, liability limitations, and governing law.

Payments and charges: Verify payment providers, currencies, taxes, shipping fees, customs/import charges, and whether any payment details are handled directly by Westbury.

Advertising and tracking: Meta Pixel and Google Ads tracking are principally privacy-policy and consent matters. Ensure the Privacy Policy accurately describes the tools actually installed, the information they collect, relevant purposes, and applicable choices/consent mechanisms. Do not claim that consent banners or opt-outs exist unless configured.

Email and contact details: Confirm that `harrydigi001@gmail.com` is the correct customer-service address and add any legally required business contact information.

10. Legal review: This is a drafting aid, not legal advice. Have the final Terms reviewed for the jurisdictions in which Westbury operates and sells.
